Borough Public Statement on Litigation – June 6, 2013
“Borough Council Receives Notice of Litigation
The Borough of State College has received a notice that a law suit has been filed in Centre County on behalf of Columbia Gas of Pennsylvania in connection with the action taken by the Borough in not approving the right-of- way permit for the installation of a natural gas pipeline through residential neighborhoods in the Borough. This notice comes following the denial of a request for an administrative review of the Borough’s previous action to not approve the permit by Borough Manager Thomas Fountaine.
Given the filing of this law suit, the Council and staff will provide no further comment on this matter. Council and staff understand that the public is extremely concerned about the natural gas pipeline. Concerns about safety and the need for transparency in decisions that affect the health, safety and welfare of the community have been heard by Council, and the Borough is fully committed to defending its position in not permitting this pipeline installation through residential neighborhoods.
The Borough also acknowledges the efforts by Penn State University and Columbia Gas of Pennsylvania to seek alternative routes for the installation of the gas pipeline. The Borough understands that the reevaluation of alternative routes for this project is complicated and will take time to complete. The Borough is appreciative of the effort by Penn State University to find an acceptable alternative and desire of Columbia Gas of Pennsylvania to postpone further consideration of the litigation until the alternative routes are fully considered and selected for the installation of the natural gas pipeline.”
